Terms of Service

Amber is operated by Vibes Ventures, Inc. ("Amber," "we," "us," or "our"). By accessing or using Amber at discoveramber.app (the "Service"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

You must be at least 18 years old to create an account or use the Service. By creating an account, you represent and warrant that you are 18 or older.

If we learn that a user is under 18, we will terminate that account. If you believe an underage person is using Amber, contact us at hello@discoveramber.app and we will investigate and remove the account.

We do not knowingly collect information from anyone under 18. We are not responsible for users who misrepresent their age in violation of these Terms.

You are responsible for maintaining the security of your account and for all activity that occurs under it. You agree to provide accurate information when registering and to keep it current. You may not share your account credentials or allow others to access your account.

You retain all ownership rights to the photos, text, and other content you upload to Amber ("Your Content").

By uploading Your Content, you grant us a limited, non-exclusive, worldwide, royalty-free license to store, host, reproduce, and display Your Content solely for the purpose of operating and providing the Service to you and the recipients you choose. This license ends when you delete Your Content or your account, except for content already delivered to recipients via email or accessed through a share link.

You represent that you have the right to upload Your Content and that it does not infringe anyone else's rights.

Amber allows you to share albums through links that can be viewed without an account, and to send albums by email to recipients you select.

You are responsible for who you share with. Anyone who has a share link can view that album and may forward the link to others. Do not share content through Amber that you would not want seen by anyone who receives the link.

You are responsible for having permission to send email to the addresses you add as contacts.

You agree not to use Amber to:

• Upload content that is unlawful, harassing, defamatory, obscene, or infringing
• Upload sexually explicit material or content depicting minors inappropriately
• Impersonate any person or misrepresent your affiliation with anyone
• Send unsolicited bulk email or spam
• Attempt to access accounts, data, or systems you are not authorized to access
• Scrape, crawl, or use automated means to access the Service
• Interfere with or disrupt the Service or its infrastructure
• Use the Service for any commercial purpose without our written permission

We may remove content or suspend accounts that violate these Terms, at our discretion and without notice.

You may delete your account at any time. We may suspend or terminate your access to the Service at any time, with or without cause or notice.

Upon termination, your right to use the Service ends immediately. Content already sent to recipients or accessed via share links may persist outside our control.

Amber is provided on an "as is" and "as available" basis. We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any content will be preserved without loss.

You are responsible for maintaining your own backups of any content you consider important. Amber is not a backup service.

TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, VIBES VENTURES, INC. WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF DATA, CONTENT, OR PROFITS, ARISING FROM YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100) OR THE AMOUNT YOU PAID US IN THE TWELVE MONTHS PRECEDING THE CLAIM, WHICHEVER IS GREATER.

You agree to indemnify and hold harmless Vibes Ventures, Inc. from any claims, damages, or expenses arising from Your Content, your use of the Service, or your violation of these Terms.

We may update these Terms. If we make material changes, we will notify you by email or through the Service. Continued use after changes take effect constitutes acceptance.

These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
